The problem? The plaintiffs allege these beverages contain none of these foods, relying instead on a \u201c<em>chemical soup<\/em>\u201d of flavors and colors to create the illusion of fruit.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-183855\" src=\"https:\/\/yogaesoteric.net\/wp-content\/uploads\/2025\/01\/Starbucks.jpeg\" alt=\"\" width=\"560\" height=\"374\" srcset=\"https:\/\/yogaesoteric.net\/wp-content\/uploads\/2025\/01\/Starbucks.jpeg 640w, https:\/\/yogaesoteric.net\/wp-content\/uploads\/2025\/01\/Starbucks-300x200.jpeg 300w\" sizes=\"auto, (max-width: 560px) 100vw, 560px\" \/><\/p>\n<p>The lawsuit, filed by plaintiffs Joan Kominis and Jason McAllister, has been given the green light to proceed after U.S. District Judge John Cronan rejected Starbucks\u2019 motion to dismiss the case. The judge determined that the claims presented by the plaintiffs are significant enough to warrant further examination in court.<\/p>\n<p>Starbucks attempted to dismiss the lawsuit, asserting that the names of the <em>Refreshers<\/em> describe the flavors, not the actual ingredients. The coffee chain argued that customers could clarify any confusion about the drinks by asking their baristas.<\/p>\n<p>Judge Cronan, however, disagreed, ruling that \u201c<em>a significant portion of reasonable consumers could find [the names] misleading<\/em>.\u201d He allowed nine of the lawsuit\u2019s 11 claims to proceed, dismissing only two: an intentional fraud claim and a repetitive unjust enrichment claim.<\/p>\n<p>\u201c<em>Unlike in some cases, no information in the name or advertising for the Products affirmatively informs the consumer whether a fruit name indicates a flavor or ingredient<\/em>,\u201d Judge Cronan wrote in his decision.<\/p>\n<p>Starbucks first launched its <em>Refresher<\/em> line in 2012, describing it as a \u201c<em>global breakthrough beverage innovation<\/em>\u201d made with \u201c<em>real fruit juice<\/em>\u201d and offering a boost of energy from green coffee extract.<\/p>\n<p>Since then, the cold beverage category, including <em>Refreshers<\/em>, has become a cornerstone of Starbucks\u2019 success.
