Groundbreaking ruling: US appeals court rules that covid mRNA injections are not vaccines

The United States Court of Appeals for the Ninth Circuit has just dropped a bombshell on the covid mass vaccination agenda.

The Court of Appeal has made a seismic ruling on the nature of covid mRNA injections.

The decision could change health policy across the country.

The ruling came in a controversial case involving the Health Freedom Defense Fund and other plaintiffs against the Los Angeles Unified School District (LAUSD).

In its ruling, the court found that covid-19 mRNA injections are not considered vaccines under the conventional medical definition.

The case concerned LAUSD’s covid vaccination policy.

The policy required that all employees be fully vaccinated against covid by a certain date.

The plaintiffs argued that the district’s vaccination requirement violated their fundamental right to refuse medical treatment.

They argued that the mRNA vaccine does not prevent the transmission of covid, but at best alleviates the recipient’s symptoms.

The court’s opinion was written by District Judge R. Nelson and joined by Judge Collins.

The judges argue that the mRNA injections marketed as vaccines are not effective in preventing the transmission of covid.

In their opinion, the judges point out that the injections only alleviate the symptoms of people infected with the virus.

Therefore, the injections could not be called vaccines.

This important distinction undermines the fundamental premise of vaccination mandates enforced by various government and educational institutions, as the Gateway Pundit notes.

Judge Nelson pointed out that the mandate contradicts the century-old Supreme Court decision in Jacobson v. Massachusetts.

This case confirmed the state’s right to mandate smallpox vaccination because it was proven to prevent the spread of disease.

In contrast, the covid mRNA vaccines offer no such public health benefit. They therefore do not meet the criteria set out by Jacobson.

The ruling points out that conventional vaccines are designed to provide immunity and prevent transmission. This has not been conclusively proven for the covid mRNA injections. Furthermore, covid mRNA injections have been linked to widespread damage and mass deaths.

The Gateway Pundit has previously reported that the Centers for Disease Control and Prevention (CDC) has changed the definition of “vaccine” to include mRNA injections.

Here is the definition used by the CDC on August 26, 2021:

  • Vaccine – “a product that stimulates a person’s immune system to produce immunity to a specific disease.”
  • Vaccination – “the process of introducing a vaccine into the body to produce immunity to a specific disease.”

Instead of admitting that the covid vaccine does not work as promised, the CDC has taken a page from Orwell’s 1984.

Instead, the taxpayer-funded agency opted for a new interpretation of the language.

The current CDC definition is:

  • Vaccine – “a preparation used to stimulate the body’s immune response against a disease”.

As Slay News previously reported, Janine Small, Pfizer’s president of international markets, admitted at an EU hearing in October 2022 that the vaccine was never tested for its ability to prevent transmission.

This groundbreaking admission contradicted previously announced claims.

Health authorities and the media put pressure on the population to get vaccinated, arguing that they had a responsibility to protect others.

In a concurring opinion, Judge Collins noted that mandatory medical treatments for the benefit of a person’s health violate the fundamental right to refuse such treatment.

This view is consistent with constitutional principles protecting personal freedom from unjustified state interference.
