Italian court officially recognizes serious vaccine injury for the first time

A recognized case of vaccine injury following a covid jab has led to a landmark court ruling. The civil court in Asti, Italy has confirmed the causal link between the vaccination and a serious neurological condition suffered by a 52-year-old woman and ordered the Ministry of Health to pay her monthly compensation.

In a first-instance ruling that could have far-reaching consequences, the civil court of Asti recognized a direct causal link between a covid-19 vaccination and severe neurological damage suffered by a 52-year-old woman. The Ministry of Health, which had initially rejected the woman’s claim through administrative channels, has now been ordered to pay her monthly compensation. The victim, the owner of a shop in Alba, in the province of Cuneo, is now unable to walk.

From symptom to protracted legal battle

The woman’s ordeal began in April 2021, shortly after she received two doses of the Pfizer-BioNTech mRNA vaccine, Comirnaty. She initially developed mild symptoms, which progressed to severe transverse myelitis – an inflammation of the spinal cord. In February 2022, she was treated at a hospital in Orbassano, near Turin. In her discharge report, the doctors stated that a contributing factor of the vaccination could not be ruled out. Despite this medical assessment, the Ministry of Health rejected her claim for statutory compensation. The family subsequently took legal action.

The court in Asti based its decision, issued on September 26, on the expert opinions of two appointed experts. The judges considered the short interval between the administration of the vaccine and the onset of the first symptoms to be decisive. They also referred to the database of the Italian Medicines Agency (AIFA), which had already recorded 593 cases of transverse myelitis following covid vaccinations up to 2022.

The court awarded the woman statutory compensation of approximately 3,000 euros per month. This is not compensation based on fault, but rather a legally mandated payment for recognized vaccine injuries.
