Yoga School MISA abused by the Romanian authorities for two years
The events that MISA has underwent since March 2004 till April 2006
• March 18, 2004
“The Romanian Police and Gendarmery started the largest action since 1989”. 300 gendarmes and prosecutors searched 16 locations of the yogis. There have been several procedure breaches committed by the prosecutors and gendarmes during the searching, such as disclosing the professional secret, abuse in service – damaging, abuse in service by denial of rights (the right to legal assistance, for instance), abusive behaviour, torture, threatening, illegal arrest and abusive searching, larceny against private interest, theft, trespassing, preventing subjects from attending trials, the attempt of determining false statements – abusive searching and public instigation.
• March 28, 2004
The Nădlac customs setup. Gregorian Bivolaru was arrested at Nădlac around 9 pm on charges of attempt of illegal crossing of the border. The MISA spiritual leader was put under detention although the offence he was charged with is not provided pre-trial detention. On March 29 Gregorian Bivolaru was taken from Arad to Bucharest Court of Appeal under incredible escort. By midnight the Tribunal of Bucharest decided pre-trial arrest for Gregroian Bivolaru on 29 days term. New accusation is forged of sexual intercourse with minor, based on a false declaration signed under pressure by Madalina Dumitru, one of the 80 persons taken to the Prosecutor’s Office on March 18. The latter soon got 18 after few months was the only underage found in the searched locations.
• April 1, 2004
Gregorian Bivolaru was set free subsequent to the exceptions pleaded by his lawyer.
The prosecutors of the Bucharest Court of Appeal issued a writ to urge Madalina Dumitru to a medical examination to assess whether she had sexual intercourse, on which purpose she was taken under escort to the Forensic Medicine Institute. Although Madalina rejected this control and in such cases the forensic medical examination only occurs under the injured party approval, she was sequestered together with her lawyer Adina Solomonand they have both been aggressed by the gendarmes. The yogis gathered on the spot at the INML Forensic Medicine Institute were beaten by the gendarmes and one of them was taken to the hospital in coma.

Danish member of the European Parliament Ulla Sandbaek repeatedly points to the Romanian authorities for their persecutions against the MISA mentor.
• June 1st 2004
Gregorian Bivolaru was subject to prosecution by the magistrates of the 5th District Court who issued a warrant of arrest on 26 days term to be enforced at the time he is caught.
• June 22, 2004
100 days after the March 18, the yogis streched a human chain round the People House in order to protest against the abusive searching aginst the MISA yoga School. Since March 2004 till april 2006 MISA protested in more than 150 manifestations at the General Prosecutor’s Office, at the Minister of Justice, at the Superior Council of Magistrates, at the Romania Governnment, Parliament or President House.

MISA mentor is pursued worldwide by the Interpol.
• August 16, 2004
The prosecutors at the Prosecutor’s Office near the Bucharest Court of Appeal sent Gregorian Bivolaru to trial on charges of sexual intercourse with a minor and attempt of illegal crossing of the border.
• October 1st, 2004
The scandal Simona Lungu is launched. The judge Simona Lungu was accused of starring a pornographic movie. After an aggressive broadside and unbearable pressure she resigned her magistrate office.
• October 2nd, 2004
The first appearance in Gregorian Bivolaru trial on charges of alleged sexual intercourse with minor and attempt of illegal crossing of the border.
• November 25, 2004
The trial of Gregorian Bivolaru is moved to Sibiu, subsequent to MISA lawyers request.
• March 16, 2005
Gregorian Bivolaru submitted the residence request at the Sweden Immigration Authority by Malmo. The request was motivated by the persecutions he underwent in Romania since the 80s and mostly since March 18, 2004.
• April 2005
The International Yoga Federation contacts the Swedish Foreigners Authority in order to express support for Gregorian Bivolaru. Still in April, Ulla Antilla the Finnish spokeman for the Parliament board for the human rights submitted a letter to the Swedish authorities to support Gregorian Bivolaru.
• April 4, 2005
During the second appearance in the procedure of the asylum request, at Malmo, on April 4, 2005, the MISA mentor is arrested by the Interpol due to the international warrant issued by the General Police Department almost a year before. Gregorian Bivolaru remained to custody at the malmo Police since April till October.
• April 11, 2005
The Romanian State submits in Sweden the first extradition request for Gregorian Bivolaru, on account of sexual intercourse with minor.
• April 15, 2005
Ruling on the request submitted by the Court of Appeal Prosecution, the Tribunal of Bucharest issued the second warrant of arrest for Gregorian Bivoalaru. For this second file Gregorian Bivoalru is accused of human beings trafficking together with 16 persons. In the case of this second warrant not even his lawyers have been announced, he was not summoned to court, though he was known the location neither examined.
• April 26, 2005
The second extradition request was submitted to Sweden on acocunt of the second warrant of arrest.
• May 7, 2005
70 locations belonging to the yogis are granted ensuring sequester – among which private houses, flats, cellars, family residences, foundation locations. The prosecutors justified the decision as a demand to cover the 8 euros millions damages claimed by the seven false witnesses in the human beings trafficking file. The locations have not been properly assessed according to law.
• May 16, 2005
Elena Sandu, the prosecutor at the Prosecutor Office at the High Court of Justice decides non-prosecution (issues a NUP ordinance) for the prosecutors accused in the yogis complaints concerning the searching on March 18, 2004 on grounds of inexisting deeds. None of the hundreds claimers yogis was examined.
• August 16, 2005
The Immigration Office of Malmo declined the residence request due to the political stake of the case concerning the Romania acceeding EU. Gregorian Bivolaru challenged to appeal the decision.
• October 11-12 2005
The Supreme Court of Justice in Stockholm, Sweden, ruled on the extradition request submitted by the Romanian authorities for Gregorian Bivolaru
• October 20, 2005
Gregorian Bivolaru was released, after almost seven months detention in the Swedish Police.
• October 21, 2005
The Supreme Court of Justice in Stockholm declines the requests submitted by the Romanian authorities stating that Gregroian Bivolaru “cannot have a fair trial in Romania” and “might be inflicted serious persecutions due to his religious beliefs”.
• November 11-13 2005
The first Congres of the European Yoga Federation, was organised by MISA at Bucharest, which confirmed the value of the spiritual school founded by Gregorian Bivoalru. The MISA mentor was thereby granted life membership in the International Yoga Federation Board.
• November 2005
Elmar Brok, chairman of the External Affairs Board in the European Parliament mails the Romanian Authority officers in charge with Romania acceeding EU in respect of Gregorian Bivolaru case. Brock is asking details for the way Romania is goingto apply the european standars in justice and the way Gregorian Bivolaru would be granted security in case he comes back home.
• November 16, 2005
the Bucharest Court of Appeal rejects in a secret meeting the appeal to the warrant of arrest issued for Gregorian Bivolaru on charges of human beings trafficking at 15.04.2005. the warrant was issued diregarding the legal procedures and attended by a defender appointed by the judge, although the chosen lawyers of Gregorian Bivolaru were quite well known. The trial conclusion on April 15, states one of the reasons for sending Gregorian Bivolaru to jail such as: “he claims himself an enlightened being”.
• December 16, 2005
Minister of Justice, Monica Macovei, asked the Superior Council of Magistrates and the Prosecutor’s Office near the High Court of Cassation and Justice to investigate the procedure observance in the file of Gregorian Bivolaru.
• December 2005
Swedish deputy Carl B. Hamilton inquired the Swedish Home Affairs Ministry and Government, stating that given the Sweden rejection of extraditing the MISA mentor, there issue of the Swedish support for Romania acceeding EU is out of the question.
• December 23, 2005
The Foreigners Office of Malmo, Sweden granted Gregorian Bivolaru the right of permanent residence under the refugee status. The decision is final and cannot be challenged by the Romanian State.
• February 1st, 2006
the investigation in the matter of the MISA and Gregorian Bivolaru case, requested by the Romanian Minister of Justice is finished, but the conclusions are not stated out.
• January-February 2006
The MISA yogis hold dayly protests in front of the Superior Council of Magistrates, asking for the investigation of the abuses they have been denouncing since March 2004. Meanwhile the number of the MISA followers accused of human beings trafficking turns to 40, on account of the same false statemements. Only a small part of the goods abusively confiscated during the searching in March 2004 have been returned.
• February 22, 2006
The report of the CSM inspectors was apporved in am open meeting. Away from truth and from any claryfing clue, the report literly is a defiance for the common right. In short the yogis are accused of having framed by themselves the abuses that thay have been denouncing for two years. The Minister of Justice request of checking the procedure observance in the case of Gregorian Bivolaru is taken as a political interference to justice.

The yogis keep up their protests, though threatened by assaults and the City Hall council attempts to obstruct them.
• April 4, 2006
The MISA representatives meet the Board of the Humna Rights in the Deputy Chamber and speak out there the abuses committed against the yogis, asking for a Parliament commission to be set up in order to “minutely” investigate the MISA case.
